Acelinks.Jobs (hereinafter referred to as "the Platform", "we", "us", or "our") is a premier recruitment and job-matching platform operating within Australia. We respect the privacy of every individual who visits our platform, uses our mobile applications, or utilizes our matching services.

This Privacy Policy forms an integral part of our operational framework and outlines our ongoing obligations to you in respect of how we manage your Personal Information. We are strictly bound by the Privacy Act 1988 (Cth) (the "Privacy Act"), the 13 Australian Privacy Principles (APPs) contained in Schedule 1 of the Privacy Act, and, where applicable, the Privacy and Personal Information Protection Act 1998 (NSW) (the "PPIP Act").

By registering an account, uploading a resume, creating an employer profile, or otherwise interacting with the Platform, you explicitly consent to the collection, storage, use, and disclosure of your personal information as described in this policy.

2. The Types of Personal Information We Collect

To provide a highly optimized recruitment marketplace, we must collect varying levels of personal and professional data.

2.1 Candidate and Job Seeker Data

  • Identity and Contact Information: Full name, date of birth, gender, residential address, email address, telephone numbers, and profile photographs.
  • Professional History and Employment Profiles: Curriculum Vitae (CV), resumes, cover letters, employment history, job titles, salary expectations, professional skills, academic qualifications, certifications, and professional memberships.
  • Verification and Right-to-Work Data: Passport details, visa status, Australian citizenship status, working holiday parameters, or work rights verification documents (VEVO checks).
  • Reference and Background Information: Referee contact details, references provided by third parties, and result logs of pre-employment screening or police checks where authorized.

2.2 Employer and Recruiter Data

  • Corporate Identity: Company legal entity name, trading name, Australian Business Number (ABN), Australian Company Number (ACN), corporate website URL, and registered physical address.
  • Authorized Representative Information: Name, corporate email address, direct telephone line, department, and job title of individual recruiters, HR personnel, or managers administering the account.
  • Billing and Financial Records: Credit card tokens, bank account details, transaction histories, and billing addresses (processed via PCI-DSS compliant third-party payment gateways).

2.3 Automated and Technical Information

  • Usage Metadata: IP addresses, device identifiers, browser types, operating systems, geographic location data, clickstream paths, time-stamps of visits, and interactions with job listings, AI features, or other users.
  • Cookies and Tracking Technologies: Session cookies, persistent cookies, and tracking pixels deployed to optimize platform navigation and remember user preferences.

3. Methods of Collection

We collect personal information through lawful and fair means, primarily directly from you.

3.1 Direct Collection

Information is collected directly when you:

  • Register an account as a Candidate or Employer.
  • Upload, input, or modify your profile, resume, or job advertisements.
  • Communicate with us via online chat, email, feedback forms, or support tickets.
  • Interact with our integrated Artificial Intelligence (AI) parsing, generation, or chat systems.

3.2 Indirect and Third-Party Collection

In certain circumstances, we may collect information about you from third parties, such as:

  • Professional networking platforms (e.g., LinkedIn) when you choose to log in or import data via their API.
  • Nominated referees during an employer's vetting process.
  • Background check providers and educational institutions verifying credentials.
  • Publicly available registries or social media platforms to verify employer legitimacy.

4. Purposes of Collection, Holding, and Use

We collect and use your personal information to deliver a comprehensive, robust, and secure recruitment platform. The primary and secondary purposes include:

4.1 Platform Operations and Matching

  • Enabling candidates to browse, save, and apply for employment vacancies.
  • Enabling employers to search, filter, review, and contact candidates within our resume database.
  • Utilizing automated systems and algorithmic AI technologies to match candidates with appropriate employment vacancies based on skills, geography, and experience.

4.2 Account Administration and Customer Support

  • Verifying user identities during account creation and subsequent logins.
  • Processing payments, issuing tax invoices, and managing corporate subscriptions.
  • Responding to customer service requests, technical bugs, or platform inquiries.

4.3 Platform Security and Fraud Prevention

  • Monitoring platform activity to detect, investigate, and prevent fraudulent job ads, scam operations, identity theft, or cybersecurity breaches.
  • Protecting the integrity of the recruitment marketplace from malicious actors.

4.4 Marketing and Analytics

  • Sending system notifications, job alerts, and platform update communications.
  • Conducting data analytics, market research, and behavioral tracking to improve user experience and platform layout.
  • Providing targeted marketing or promotional offers regarding premium platform features (subject to your right to opt out at any time under the Spam Act 2003 (Cth)).

5. Disclosure of Personal Information

We do not sell your personal information to third parties. However, to operate the recruitment marketplace effectively, your information may be disclosed to the following entities:

5.1 Disclosures Between Platform Users

  • Candidates to Employers: When a candidate applies for a job listing, their profile, resume, and application notes are made entirely visible to the respective employer. Furthermore, if a candidate selects a "Public" or "Searchable" profile status, their data becomes visible to all validated employers utilizing our database search engine.
  • Employers to Candidates: Information regarding the employer's company, history, location, and the identity of the posting recruiter may be visible to candidates browsing or applying for jobs.

5.2 Disclosures to Third-Party Service Providers

We engage specialized third-party vendors to perform operational functions on our behalf. These include:

  • Cloud hosting infrastructure providers (e.g., Amazon Web Services, Microsoft Azure).
  • Payment processing networks.
  • External AI engine infrastructure providers (e.g., OpenAI, Anthropic) utilized for processing text, parsing resumes, and generating matching metrics.
  • IT security, analytics, and CRM software providers.

5.3 Legal and Regulatory Disclosures

We will disclose personal information if required or authorized to do so by law, or if we believe in good faith that such disclosure is necessary to:

  • Comply with statutory obligations under Australian Commonwealth or NSW State legislation.
  • Respond to a valid subpoena, warrant, or court order from an Australian court.
  • Assist law enforcement agencies in investigating potential criminal acts or platform abuse.
  • Protect the safety, property, or legal rights of Acelinks.Jobs, its users, or the general public.

6. Cross-Border Data Transfers (APP 8)

Acelinks.Jobs operates primarily within Australia; however, the cloud servers, technical support networks, and AI engine APIs we utilize may be hosted internationally (including but not limited to the United States, Singapore, and the European Union).

Before disclosing any personal information to an overseas recipient, we take all reasonable steps to ensure that the overseas recipient handles your personal information in accordance with the APPs, or is subject to a law or binding scheme that provides substantially similar protection to the Privacy Act 1988 (Cth). By providing your data, you acknowledge and consent to these cross-border data flows.

7. Data Security, Compliance, and Storage

We take the security of your data seriously. We hold your personal information in a combination of secure electronic databases, cloud servers, and, where applicable, secure physical files.

  • Security Mechanisms: We utilize industry-standard security protocols, including Secure Socket Layer (SSL/TLS) encryption for data in transit, AES-256 encryption for data at rest, robust multi-factor authentication (MFA) protocols for administrative access, and regular vulnerability scanning.
  • Data Retention Policies: We retain your personal information only for as long as your account remains active or as required to fulfill the recruitment and business purposes outlined in this policy. If you close your account, we will systematically delete or permanently anonymize your data, unless statutory obligations (such as the Corporations Act 2001 (Cth) or tax laws) mandate longer retention periods.
  • Data Breach Notification: In the event of an unauthorized data breach resulting in material risk or serious harm to our users, we will immediately enact our Data Breach Response Plan and comply fully with the Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988 (Cth) by notifying the affected individuals and the Office of the Australian Information Commissioner (OAIC).

8. Access to and Correction of Your Information (APP 12 & 13)

You have a legal right under Australian privacy law to access the personal information we hold about you and to request its correction if it is inaccurate, out of date, incomplete, irrelevant, or misleading.

  • How to Access/Correct: Most profile and resume data can be updated or corrected directly through your user account dashboard. Alternatively, you may submit a formal request to our Privacy Officer.
  • Identity Verification: To protect the privacy and security of your information, we will require you to adequately verify your identity before granting access or making substantive modifications.
  • Refusal and Grounds: In rare instances allowed under APP 12.3, we may refuse access (e.g., if granting access would breach the privacy of another individual or prejudice an ongoing legal investigation). If we refuse, we will provide you with a comprehensive written statement outlining the legal grounds for refusal and the mechanisms available to complain.
