Section A: General Platform Terms and Legal Foundation

1. Contractual Binding Agreement

Welcome to Acelinks.Jobs (the "Platform"). This website, application, and matching service are owned and operated by AUSTRALIA CAREER AND EDUCATION COMMITTEE PTY LTD (ABN 62 634 680 863), along with its subsidiaries, affiliates, and designated representatives (collectively referred to as "we", "us", "our", or "Acelinks.Jobs").

These Terms and Conditions, together with our Privacy Policy and any specific commercial schedules attached hereto, constitute a legally binding contractual agreement between Acelinks.Jobs and any person or entity accessing, browsing, registering, or utilizing the platform (hereinafter referred to collectively as "Users", or specifically as "Candidates" or "Employers").

By clicking "I Agree", checking an registration consent box, or otherwise utilizing any aspect of the Platform, you warrant that you have read, understood, and agreed to be bound by these terms. If you do not accept these terms in their entirety, you must immediately cease all access and use of the platform.

2. Legal Capacity and Variation of Terms

  • Eligibility: You warrant and represent that you are at least 18 years of age and possess the legal capacity and authority to enter into a binding financial and operational contract under the laws of New South Wales and the Commonwealth of Australia. If you register an account on behalf of a corporate entity, you explicitly warrant that you are an authorized representative with the legal power to bind that corporation.
  • Amendments: Acelinks.Jobs reserves the right, at its absolute discretion, to modify, update, vary, or replace these Terms and Conditions at any time. We will provide notification of significant modifications by posting an alert on the homepage or emailing registered users. Continued utilization of the platform after the publication of modifications constitutes an unreserved acceptance of the revised terms.

3. Intellectual Property Rights

All materials, content, source code, data architectures, matching algorithms, user interface designs, graphics, logos, trade marks, and systems integrated within Acelinks.Jobs are the exclusive property of Acelinks.Jobs or its licensors and are protected under the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth), and international intellectual property treaties. Users are granted a limited, non-exclusive, revocable, non-transferable license to access the platform solely for internal hiring or individual job-seeking activities.

Section B: Artificial Intelligence (AI) Integration and Usage Policy

Acelinks.Jobs incorporates cutting-edge generative and predictive Artificial Intelligence (AI) models to facilitate resume processing, structural formatting, job description drafting, automated matching scoring, and conversational assistance. To the maximum extent permitted by Australian law, all interaction with our AI features is governed by the following strict provisions:

1. Absolute Disclaimer / No Guarantee of Accuracy and Results

  • "As-Is" Provision: All outputs, metrics, suggestions, automated resume revisions, and applicant match scores generated by our AI models are provided strictly on an "as-is" and "as-available" basis without warranties of any kind.
  • Limitations of AI: You acknowledge that AI technology is inherently subject to algorithmic limitations, data anomalies, and potential "hallucinations" or logical errors.
  • No Employment Warranty: Acelinks.Jobs does not warrant, promise, or guarantee that utilizing AI features will result in successful placement, accurate candidate filtering, increased interview rates, or the identification of a flawless candidate match.

2. Sole User Responsibility and Mandatory Verification

  • Final Content Owner: The user (whether Employer or Candidate) retains sole, exclusive, and ultimate legal responsibility for any content processed, finalized, published, or utilized via the AI features.
  • Mandatory Review: Employers must manually verify and approve any AI-generated job advertisements before publication to ensure compliance with employment standards. Candidates must thoroughly audit any AI-optimised resumes or cover letters to ensure every factual statement aligns with reality before submission.
  • Waiver of Liability: Acelinks.Jobs explicitly disclaims all liability for any loss, legal penalties, reputational damage, or employment disputes arising from a user's unverified reliance on AI-generated suggestions or texts.

3. Strict Prohibition Against Third-Party and Confidential Data Uploads

  • Confidentiality Scope: Users are strictly prohibited from copying, pasting, typing, uploading, or otherwise transmitting into the AI prompt interfaces any third-party confidential business information, trade secrets, highly restrictive proprietary source codes, or unauthorized personal data.
  • Privacy Compliance: You must not input personal details belonging to another individual into the AI engine unless you have obtained explicit, written prior consent that complies fully with the Privacy Act 1988 (Cth).
  • Indemnity for AI Inputs: Any user who breaches this clause and causes third-party data leaks via the platform's AI interfaces agrees to indemnify Acelinks.Jobs against any resultant regulatory fines, claims, or legal actions.

Section C: Employer Recruitment Agreement

This Section governs the legal relationship between Acelinks.Jobs and any corporate entity, business owner, hiring manager, or recruitment agency utilizing the platform to source personnel.

1. Rigorous Candidate Data Protection and Privacy Mandates

  • Authorized Use Only: Employers who gain access to candidate profiles, resumes, contact details, or screening logs through Acelinks.Jobs are legally bound to handle, store, and process that information in strict compliance with the Privacy Act 1988 (Cth).
  • Internal Purpose Restriction: Candidate data accessed via the platform must be used solely and exclusively for the legitimate, internal evaluation of that candidate for a specific, genuine employment vacancy.
  • Prohibited Transmissions: Employers must not sell, lease, redistribute, broadcast, or harvest candidate data for marketing databases, third-party distribution, or any external promotional campaign.
  • Data Security Duty: Employers must implement appropriate administrative, physical, and technological security controls to ensure that candidate resumes downloaded from Acelinks.Jobs are protected against unauthorized access or disclosure.

2. Recruitment Fees, Corporate Billing, and Cancellations

  • Fee Structure: Fees for premium job listings, automated AI matching bundles, resume database subscriptions, and targeted advertising slots are specified in the platform's commercial checkout matrix or a tailored corporate Service Agreement.
  • Currency and GST: All transactions are conducted in Australian Dollars (AUD). Prices are subject to Goods and Services Tax (GST) in accordance with A New Tax System (Goods and Services Tax) Act 1999 (Cth), which will be explicitly detailed on all tax invoices.
  • No-Refund Policy & Australian Consumer Law (ACL): To the maximum extent permitted by Schedule 2 of the Competition and Consumer Act 2010 (Cth) (the Australian Consumer Law), all fees paid to Acelinks.Jobs are non-refundable. Refunds, credits, or fee adjustments will only be issued if required by statutory consumer guarantees or if Acelinks.Jobs materially breaches its operational service levels. Change-of-mind, unsuccessful hiring outcomes, or accidental duplicate postings do not constitute grounds for a refund.

3. Zero-Tolerance Fraudulent Recruitment and Deceptive Posting Clause

  • Prohibition of Misleading Content: Employers must not post any job advertisements that are false, deceptive, or misleading, in breach of Section 18 or 31 of the Australian Consumer Law.
  • Banned Listing Typologies: Acelinks.Jobs maintains a zero-tolerance policy against fraudulent activities. Prohibited ads include, but are not limited to:
    • Pyramid schemes, multi-level marketing (MLM) structures, or network marketing positions.
    • Opportunities requiring the candidate to pay upfront fees, purchasing mandatory training packages, or investing initial capital.
    • Fake listings designed solely to scrape candidate contact lists or harvest competitive market intelligence.
    • Job opportunities that involve illegal or unregulated operations.
  • Right of Removal: We reserve the absolute right to audit, flag, suspend, or permanently delete any job advertisement that we suspect violates this clause, without notice and without any obligation to refund fees.

4. Employer Liabilities, Fair Work Compliance, and NSW Law

  • Fair Work Compliance: Employers explicitly warrant that all job ads, remuneration structures, and employment terms offered comply with the Fair Work Act 2009 (Cth), applicable National Modern Awards, and the National Employment Standards (NES).
  • Anti-Discrimination Mandate: Employers must ensure that no job advertisement contains discriminatory requirements based on race, sex, age, marital status, physical or mental disability, sexual orientation, religion, or political stance. All listings must adhere strictly to the Anti-Discrimination Act 1977 (NSW) and Commonwealth anti-discrimination statutes.
  • Workplace Safety Liability: The employer assumes sole legal liability for providing a safe workplace in accordance with the Work Health and Safety Act 2011 (NSW). Acelinks.Jobs acts purely as a digital introductory marketplace and disclaims all liability for physical injuries, contractual breaches, or workplace disputes occurring between the employer and an introduced candidate.

Section D: Candidate User Agreement

This Section governs the legal rights and obligations of individuals accessing the platform to create profiles, seek employment, or submit applications.

1. Absolute Accuracy and Truthfulness of Resumes

  • Verification Warranty: The candidate warrants, represents, and guarantees that every detail contained within their uploaded resume, cover letter, identity profile, or application submission is completely truthful, accurate, and free from misleading statements.
  • Prohibition of Falsification: Candidates must not falsify academic credentials, employment dates, past job titles, professional licenses, or visa work rights.
  • Account Revocation: If Acelinks.Jobs, or an employer via validated feedback, discovers that a candidate has deliberately submitted fraudulent credentials or deceptive profiles, we reserve the right to immediately freeze or permanently terminate the candidate's platform access. The candidate may also face civil liability for fraud under common law or statutory frameworks within New South Wales.

2. Candidate Responsibilities and Due Diligence Duty

  • Employment Vetting: Candidates acknowledge that Acelinks.Jobs does not operate as an employment agency, executive search firm, or employer of record. We do not perform comprehensive corporate background checks or financial audits on the employers who post vacancies.
  • User's Risk: Candidates are solely responsible for conducting their own robust due diligence and vetting before attending interviews, accepting employment offers, signing contracts, or resigning from current positions.
  • Independent Contractual Relationship: Any employment agreement or work contract entered into is solely between the candidate and the employer. Acelinks.Jobs is not a party to, nor liable for any terms or outcomes arising from, such agreements.

3. Data Authorization, Integrated Services, and IP Licensing

  • Licensing Grant: By uploading a resume, portfolio, text description, or profile data to Acelinks.Jobs, the candidate grants us a perpetual, irrevocable, worldwide, royalty-free, sub-licensable license to host, store, index, format, parse via AI, and display such data for the purposes of facilitating recruitment matches.
  • Visibility Adjustments: Candidates maintain full autonomy to adjust their profile visibility configurations (e.g., Public, Restricted, or Hidden) within their account panel to control how information is exposed to the employer searchable database.

Section E: Liability, Indemnity, Disputes and Termination

1. System Availability and Limitation of Liability

  • No Uptime Guarantee: While we strive to maintain uninterrupted service, Acelinks.Jobs does not warrant that the platform will operate completely error-free, securely, or without periodic downtime caused by server upgrades, carrier network disruptions, or cyberattacks.
  • Liability Cap: To the maximum extent permitted by the Australian Consumer Law, Acelinks.Jobs, its directors, employees, and agents exclude all liability for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, commercial contracts, business reputation, or data, arising out of or connected with your use of the platform.
  • Statutory Minimums: Where liability cannot be completely excluded by law but can be limited, our total liability for any breach of a non-excludable consumer guarantee is limited, at our discretion, to re-supplying the platform services or refunding the specific fee paid for the individual service under dispute.

2. Comprehensive Indemnity by Users

You agree to fully indemnify, defend, and hold harmless Acelinks.Jobs, its officers, directors, employees, and contractors from and against any and all claims, civil actions, losses, liabilities, damages, operational expenses, or legal costs (calculated on a full solicitor-client basis) resulting from or arising directly or indirectly out of:

  • Your material breach or non-observance of any provision within these Terms and Conditions.
  • Your unlawful, fraudulent, or discriminatory actions on the platform.
  • Your violation of any Australian Commonwealth or NSW State law.
  • Any infringement of third-party intellectual property rights or data privacy breaches caused by data inputs you provided.

3. Dispute Resolution Protocols

Any legal or operational dispute arising from these terms must be managed through the following mandatory phased process:

  • Phase 1: Written Notice: The aggrieved party must issue a formal, written "Notice of Dispute" to the other party, detailing the nature of the grievance and the desired remedy.
  • Phase 2: Good Faith Negotiation: Within fourteen (14) days of receiving the Notice of Dispute, senior representatives or the individuals involved must meet via video conference or in person to attempt to resolve the dispute in good faith.
  • Phase 3: Mediation: If the dispute remains unresolved after Phase 2, the parties agree to submit the matter to formal mediation in Sydney, New South Wales, administered by the Australian Disputes Centre (ADC), with costs shared equally between the parties.
  • Phase 4: Litigation: Litigation may only be commenced if mediation fails to deliver a mutually agreeable settlement.

4. Governing Law and Severability

  • Jurisdiction: These Terms and Conditions are governed by, interpreted, and enforced in accordance with the laws of the State of New South Wales, Australia. Each party irrevocably submits to the exclusive jurisdiction of the courts of New South Wales and courts authorized to hear appeals from them.
  • Severability: If any provision or clause within these terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that specific provision shall be severed or read down to the minimum extent necessary, and the remaining provisions of these Terms and Conditions shall continue in full force and effect.
